Steve Turner is a landscape designer and project manager who works for Black Diamond, and serves clients in the San Francisco Bay Area in the State of California in the United States of America. 

We invite you to read this Privacy Policy (“Privacy Policy”), which explains our privacy practices and how we handle personal information collected through Black Diamond-Steve Turner, our marketing activities, our live events, from third party sources, and other activities described in this Privacy Policy. This Privacy Policy also explains how we use and share such information and choices you have about your personal information.

We use “BlackDiamond-SteveTurner.com” to refer to the digital portfolio and schedule software of Steve Turner. 

Unless otherwise indicated, this Privacy Policy applies to all of our Services in all California only in which BlackDiamond-SteveTurner.com offers its Services. Some parts of this Privacy Policy apply only to our Services offered in California; please see Section 10 for additional information. Capitalized words used but not defined in this Policy have the meanings given in the Member Agreement.

1. What Personal Information Is Collected?

We may collect personal information about you from you directly, from other interested clients or other users of our Services, through technology that automatically collects information from your browser or device, and from third party sources. See below for examples. BlackDiamond-SteveTurner.com account types and features are available in the State of California, as Black Diamond has a C-27 license in California. Additionally, these examples are not exhaustive and we may collect personal information that is not specifically listed below, which we use consistent with this Privacy Policy. We may also provide supplemental information about our data collection or privacy practices in disclosures about specific Services or circumstances, or in some cases, at the time we collect personal information from you. Any personal information that we collect shall only be used to follow-up on appointments scheduled by interested clients, and shall not be sold or rented to third parties.

1.1 Personal information we may collect from you

  • Your personal details.
    • When you sign up for an appointment with BlackDiamond-SteveTurner.com, you will need to provide certain information about yourself, such as your name, email address, and physical address.
  • Data from other accounts. You do not have the option to use third party service, like Facebook, Google, or Apple to log in to BlackDiamond-SteveTurner.com.
  • Contact lists. You do not have the option to share or sync your contacts with BlackDiamond-SteveTurner.com. 
  • Payment information. You do not have the option to make payments on BlackDiamond-SteveTurner.com.
  • Survey data. BlackDiamond-SteveTurner.com will not conduct surveys.
  • Messages and email data. We collect information about you when you send, receive, open, read or otherwise engage with messages, email, or other communications in connection with our Services, including whether you have opened or acted on those communications. 
  • Booking information. If you book an appointment online, you will be expected to confirm the appointment and location with Steve Turner.   


1.2 Personal information we may collect from your browser or device

With your permission, where it is required by applicable laws, we, our service providers, and partners collect technical information when you visit or use BlackDiamond-SteveTurner.com, including:

  • Device data. Device data may include your device’s manufacturer and model, operating system and version, screen resolution, RAM and disk size, CPU usage, IP address, unique identifiers (including identifiers used for advertising purposes), crash data (if applicable), what device settings you’ve enabled, carrier, radio/network information (e.g., WiFi, LTE, 3G). (As described above, we may collect geolocation data from your device with your permission, or we may derive your general location, such as city, state or geographic area, from your IP address or other data.)   • Online activity data. Online activity data may include the date and time you visited, duration of access, the browser or app version you used (and its settings), the URLs you came from and went to. Information is used on a technical level, but no data is sold or rented to third-parties for any reasons.

3.1 Content you share 

BlackDiamond-SteveTurner.com is a portfolio web site that is also used to allow San Francisco Bay Area homeowners to schedule a free consultation with Steve Turner. To that end, the information you share will not be publicly visible, and will be used only to support the planning and confirmation of the appointment.


4. What Are My Choices?

You can choose to contact Steve Turner directly at 650.732.1659 or [email protected] and not schedule an appointment online. If you do schedule the free design consultation online, the information will only be used in support of that appointment. No information will be shared, sold, rented or aggregated to benefit third-parties.


5. How Long Is My Personal Information Kept?

We retain personal information you share in our server logs, our databases, and our records for as long as necessary to provide our Services. 


6. International Transfers of Personal Information

BlackDiamond-SteveTurner.com operates in California only, buy our web site is on the cloud, so  your personal information could be transferred to and processed on servers outside the jurisdiction where you live. We typically transfer personal information within the United States, which is where BlackDiamond-SteveTurner.com is headquartered and where many of our Services are based.

BlackDiamond-SteveTurner.com will only transfer personal data as permitted by law, 

For residents of Europe or countries, there is no reason to be accessing BlackDiamond-SteveTurner.com, as services by Steve Turner are not provided outside of the State of California or the United States.


7. How Is My Personal Information Protected?


7.1 Account security

BlackDiamond-SteveTurner.com uses technical and organizational measures intended to keep your data secure, including using https on our web pages to reduce the risk of unauthorized interception of your communications during your visits to the website. The internet is not a fully secure environment and we cannot guarantee that personal information won’t be intercepted or improperly accessed. We do not ask for you to create an account or use a password.

8. Personal Information Relating to Children

Homeowners are the intended users of BlackDiamond-SteveTurner.com. Children are not qualified to allowed to use our Services if they are under 13 years old. If you believe we may have collected personal information from a child in one of these categories, please contact us at [email protected] for us to investigate and delete this information as appropriate.


9. Changes to this Privacy Policy

We may make changes to this Privacy Policy from time to time, so please review it periodically. If we materially change this Privacy Policy, we will take steps to notify you in advance of the change as required by applicable law, for example by emailing you, if you have shared your data to schedule an appointment.

The notices and choices described above apply to all Interested Clients and Homeowners, and people can access, delete, or take other actions with respect to their personal information. See Section 4 above titled “What Are My Choices?”.

In addition, residents of certain jurisdictions may have specific rights or may be entitled to additional specific notices about our privacy practices.  The following sections provide those jurisdiction-specific notices and describe those rights.  If you are a resident of one of the following jurisdictions, please review the section about that jurisdiction.

Privacy Notices California  

This Privacy Notice is effective January 1, 2024. If you are a California resident, this section applies to you. This section describes how we collect, use, and share your personal information in our capacity as a “business” under the California Privacy Rights Act of 2020 (“CPRA”), and the rights that you have with respect to your personal information, including sensitive personal information. For purposes of this section, “personal information” and “sensitive personal information” have the meanings given in the CPRA and do not include information excluded from the CPRA’s scope.

Categories of recipients with whom personal information is shared or sold can be found in Section 3 of our Privacy Policy titled “How Is My Personal Information Shared with Others?”. You are asked to schedule a date for a free initial design consultation. You select the date, share your name, phone number, address, and email. No other personal information is requested.

2. What Are My Rights?

Under CPRA, California residents have the rights described below.

Please understand, however, that these rights are not absolute and are subject to exceptions, and we may be required or permitted by law to decline your request. In addition, we will not be able to process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

2.1. Right to access.

You may request the following information about how we have collected and used your personal information, including sensitive personal information, during the past 12 months:

  • the categories of personal information we have collected about you. You select the date, share your name, phone number, address, and email. No other personal information is requested, so this is considered to be a full disclosure;
  • the categories of sources from which we collected the personal information. You select the date, share your name, phone number, address, and email. No other personal information is requested.;
  • the business or commercial purposes for collecting, selling, or sharing personal information are to schedule a free design consultation. Nothing more.;
  • there are no third parties to whom we disclose the personal information;
  • there are no categories of personal information that we sell or share for a business purpose; and
  • there are no categories of personal information that we disclose for a business purpose.


2.2 Right to know.

In addition to the information listed above under the right to access, be aware that you share the information you want us to know and we do not collect, sell, rent, share or aggregate the data.

2.4 Right to delete or cancel.

No data you share is posted online and if you schedule a free initial design consultation and wish cancel, please Steve Turner at 650.732.1659 or [email protected] in advance of the appointment. 

2.5 Right to opt-out of sale or sharing.

We do not work with third parties in any way to share, sell, rent or aggregate your data.

2.6 Right to limit use and disclosure of sensitive personal information.

You can direct us to limit the use of any sensitive personal information, as defined in the CPRA, that we may collect about you.  You can opt-out of scheduling a free initial design consultation.

2.7 Right of no retaliation.

You are entitled to exercise your rights provided under California privacy law as described above free from discrimination.

3. Can I Use an Authorized Agent to Make My Request?

Yes, your authorized agent may make a request for information, access, and deletion on your behalf upon our verification of the agent’s identity and our receipt of a copy of valid power of attorney given to your authorized agent pursuant to California Probate Code Sections 4000-4465. If you have not provided your agent with such a power of attorney, you must provide your agent signed permission to exercise your CPRA rights on your behalf, provide the information we request to verify your identity, and provide us with written confirmation that you have given the authorized agent permission to submit the request. Authorized agents are required by California law to implement and maintain reasonable security procedures and practices to protect their clients’ information.
 

4. Will You Need to Verify My Identity Before Responding to My Request?

Yes, we will need to verify your identity to process your information as well as to grant access and deletion requests and reserve the right to confirm your residency.
 

5. What Are My Rights under California’s Shine the Light Law?

Under California’s Shine the Light law (California Civil Code Section 1798.83), California residents may ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide the names of third parties to which they have disclosed certain personal information (as defined under the Shine the Light law) during the preceding calendar year for their own direct marketing purposes and the categories of personal information disclosed. In your request, you must include the statement “Shine the Light Request,” and provide your first and last name and mailing address and certify that you are a California resident. We reserve the right to require additional information to confirm your identity and California residency. Please note that we will not accept requests via telephone, email, or facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.
